文章分析了预期违约的含义、构成要件、救济办法。作者认为 ,预期违约是指在合同约定的期限届满之前 ,当事人一方明确表示或以自己的行为表示将不履行合同的义务。其构成要件有三 :当事人订的合同有效成立 ;此种违约发生在合同履行期限届满之前 ;必有当事人不履行合同义务行为发生。

This paper makes an analysis of the meaning, component parts and remedies of anticipatory breaking a contract. It is pointed out that anticipatory breaking a contract means that before the expiration of a contract, one party clearly expresses not fulfilling the contract.
