在刑事司法领域,"互联网+"的出现契合了刑事司法现代化的发展需求。刑事司法无法自我隔离于现代化、信息化的时代浪潮,从技术先进性、成本经济性、目的正当性的角度出发,引进信息技术运用于刑事案件在线庭审是司法顺应时代发展的必然趋势。受制于庭审样态与庭审规则的限制,刑事案件在线庭审仍蕴含诸多风险,影响庭审实质化的实现。面对信息技术与刑事司法的深度融合,通过重新诠释传统诉讼原则,细化在线庭审规则,完善相关保障措施,力求在技术变革与审判传统、审判公正与审判效率之间寻找平衡点,实现刑事案件在线庭审的高效与规范。
