少数民族乡村治理区别于其他基层社会治理，有着典型的特点和特殊的要求，这就要求我们要在铸牢中华民族共同体意识的视野下，结合少数民族的特点，针对民族地区历史发展的实际，将少数民族地区的特色治理规范——习惯法与基层党组织发展建设进行有机融合，创新治理方式，找到适合民族地区基层治理的新型路径和方法。文章以云南红河H县作为调查样本，通过对当地习惯法从历史的角度进行系统梳理，找到习惯法与基层党组织关系的变化特点，在新时代进一步对少数民族习惯法与基层党组织的关系进行重构，从而解决民族地区的社会治理问题，推进乡村治理体系与治理能力的现代化建设。
