宅基地信托是“三权分置”下适度放活“宅基地的使用权”方式的创新，有利于促进宅基地的有效利用和切实保障农民的权益。宅基地信托可采取“农户+信托公司等受托人”的运作模式，可由现有的不动产登记机构办理宅基地信托登记。应适当限定宅基地信托受托人的权利，使其不得转让“宅基地的使用权”或以其设定抵押；对宅基地信托受托人的分别管理义务加以调整，并增设宅基地信托受托人的公平义务。宅基地信托中应设置信托监察人，由当地村民委员会担任为宜；农业农村等部门应建立对宅基地信托的监督机制。
