[目的/意义]数据权益保护是实践探讨的重要议题，正确理解数据权益的理论意蕴，构建合理的数据权益保护模式是保障企业利益、促进数字经济发展的制度基础。[方法/过程]通过文献分析、比较分析方法，文章反思了当前学界提出的企业数据权益保护理论，指出了各种理论对数据特征和保护语境的忽视，难以为数据权益保护和数据充分利用提供理论支撑。[结果/结论]数据在线上线下语境中具有不同含义，在载体、符号和内容层面具有不同的内涵，同时数据的信息内容也存在差异，应当对数据的不同内涵进行区分，针对不同的信息内容构建保护制度。而在具体模式上，可以采取公法与私法协同、权利化与行为规制结合...
