城镇化的快速推进引发了新一轮“圈地运动”，大量农民的土地权益受损，无法共享地利。本文以城镇化中的农民土地权益保障为视角，结合本土实际，对我国农村土地发展权的性质与归属进行再思考，认为在我国现有的宪法秩序与法律框架下，我国农地发展权是派生于所有权的农地使用权中的一个独立权能，是公权力对农民私权利的一种权利让渡。同时它也是有限度的，即必须服从于国家基于公共利益的规划。在厘清其性质的基础上，根据我国农村土地用途的多元特性，将农村土地发展权分为耕地发展权、宅基地发展权与经营性建设用地发展权，并分别对其归属进行了探讨。

The rapid advance of urbanization triggered a new round of ＂Enclosure Movement＂, which causes damage of a large number of farmers＇land rights and interests. They cant share the profit brought by the land.
