对法人财产权的定性问题,长期以来在中国法学界争论不休.基于对法人的财产权以及所有权、经营权等物权的比较分析,法人财产权就是经营权;而投资者对法人财产拥有股权,即让渡了部分权能的所有权.由于股份有限公司是典型的现代企业制度,故这里所讨论的法人财产权仅限于股份有限公司.
