我国古代担保制度源远流长,质、押、典、保特色纷呈,功能各异,对保障债权的实现,促进古代经济的发展起过重要作用.但由于商品经济不发达,古代担保方式存在许多缺陷,如担保方式被置于刑律之外,其法律表现形式多采用律、例、礼、经、义等形式;担保方式的含义不清,质、典、押相互代用;人"质"禁而不止;物的担保方式担保性不强,没有形成独立的担保体系,等等.
