耕地互换是指同一集体经济组织内的土地承包经营权人相互交换土地承包经营权和承包地块的行为。耕地互换既是土地承包经营权流转的重要方式,也是处理土地细碎化的有效途径。耕地互换实践中各种纠纷不断发生,现行法律规定难以对其进行有效应对。耕地互换纠纷发生的主要原因有三：一是因熟人社会向半熟人社会转变以及公权力对乡村治理的渗透,致使道德规范瓦解,并使其调控能力也随之丧失;二是因现行法律对耕地互换程序以及权利保障措施之规定存在漏洞,导致法律规范在耕地互换纠纷的预防中难以发挥作用;三是因互换后的耕地在农地流转和土地征收中的机会不对等,造成耕地价值实现以及收益获得失衡。耕...
