全面依法治国是国家治理的一场深刻革命，其基础和工作重点均在基层。司法所作为我国最基层的司法行政机构，承担着指导调解、受委托承担社区矫正工作、参与基层普法依法治理、组织提供基层公共法律服务、协调开展刑满释放人员安置帮教等职责任务。实证调研表明，绝大多数司法所的组织现状并未达到规范性文件的要求；尽管司法所已尽可能地形成调适性的工作机制，但其职能呈现与应然之间仍存在较大张力。究其原因在于司法所面临主体异化、职能超载、法治资源冲突、法治权威阙如等法治困境。优化司法所的职能定位、完善司法所的工作机制、树立司法所的法治权威，有利于司法所走出法治困境，以确保...
