综观一系列已经出台的全国性、地方性以及专项的法律、法规和规章等，应该说，农民工参加工伤保险、依法享受工伤保险待遇在政策上是明确的，于法律上也是有据的。然而，在实践中农民工参加工伤保险的比率却实在很低。为使农民工工伤保险权益得到切实保障，一方面应确保国家已出台的大量法规政策落到实处，另一方面要修改这些法规政策在实践中存在的不适应之处。应注意解决农民工受雇于个体工商户的工伤保险问题，应认识到农民工在工伤认定申请中证明劳动关系存在的困难，应采取既严格又有效的方式追究雇用农民工的用人单位的违法责任。

According to the national, local, or special laws and regulations, it is necessary for farmer la borers to be absorbed in work-related injury insurances, and it is legitimate for them to have the rights on the insurances. But now, in practice, a lot of farmer laborers are still out of the protection of work related injury insurances, and the rate of their participating in the insurances is still at a quite low level.
